Placing a home in a living trust is a common estate planning strategy – but when a property held in trust is bought or sold, title insurance requirements work a little differently than a standard purchase.
Why title insurance still matters
Title insurance protects against defects in ownership history – liens, forgeries, missing heirs, or clerical errors – regardless of whether the property is held individually or in a trust. A trust doesn’t eliminate that risk.
What title companies typically require
Insuring a trust-held property usually requires a copy of the trust agreement (or a certification of trust), documentation confirming the trustee’s authority to buy or sell on the trust’s behalf, and confirmation that the trust is properly established under state law.
Work with professionals who know trusts
Not every title company or agent handles trust transactions the same way. Working with a title company experienced in trust-held real estate helps avoid delays at closing.
